Abstract: An apparatus and method of scheduling data packets in a communication system are provided, in which the number of first-type data packets to be transmitted with priority is determined according to a predetermined criterion from among total first-type data packets, and the determined number of first-type data packets and second-type data packets are scheduled so as to transmit the determined number of first-type data packets and then transmit the second-type data packets.
