The specification and drawings present a new method, apparatus and software related product for adaptive content optimization based on real time network dynamics including at least a network load (congestion) status on a cell/access point (eNB) level and a UE subscription status. A network element of a network core such as PGW of an EPC can determine a load status of at least one access point (eNB,) using one of the two approaches described herein, and/or subscription information for one or more UEs served by the eNB. The EPC can enhance the existing protocol between the EPC and MCO by providing real time serving eNB load information and/or the UE subscription status along with a mobile content (e.g., video) request from a UE wirelessly communicating with the serving eNB to the MCO. This will allow the MCO to provide the mobile content (including bandwidth) sent to the UE.

A congestion unit is coupled to the packet inspection unit and is configured to determine a level of congestion in the communication network, the level of congestion associated with a capacity of the wireless channel, the level of congestion capable of varying over time, and the capacity of the wireless channel capable of varying with the level of congestion. A video scaling unit is configured to adjust the bit rate of the data stream responsive to the packet inspection unit and the congestion unit.

Methods and apparatus for mitigating data server time-outs in e.g., a hybrid wireless network. In one exemplary embodiment, a client device operating in a hybrid network environment utilizes its knowledge about tune-away periods so as to minimally affect data network operation especially TCP. For example, during periods of data downlink activity, the client device induces some delay in the acknowledgement packets sent back towards the network prior to entering into a tune away period. These delayed acknowledgement packets result in an increased retransmission time out period value thereby reducing the probability of encountering a data server time¬ out. Alternative embodiments are also discussed which preoccupy the network apparatus during these tune away periods so as to also mitigate time- outs during these periods. These mitigation algorithms are useful in both downlink and uplink data transmissions. Apparatus for implementing these methodologies are also disclosed.

For performing link adaptation in an Ethernet ring protection system, a link management controller (180) determines a ring protection state of an Ethernet protection ring. Further, the link management controller (180) adapts bandwidth of a link (25) of the Ethernet protection ring. Depending on the adapted bandwidth and the determined ring protection state, the link management controller (180) deactivates the link of the Ethernet protection ring. In particular, if the adapted bandwidth is below a threshold value and the ring protection state indicates that there is no link failure in the Ethernet protection ring, the link management controller (180) may deactivate the link (25).
