A data transmitting method, a data recording apparatus, a data record medium and a data reproducing apparatus are provided to disallow the encryption to be easily decoded and keep the secrecy of key information higher. The data transmitting apparatus includes an error correction coding process block. In the block, an input converting circuit operates to perform a logic operation with respect to the information data from an interface circuit 12 according to the key data. The converted information data is sent to an encoder 15 for generating parity data. This parity data is mixed with information data before conversion in a mixing circuit. The error correction coding block operates to send the resulting data to a modulating circuit 17 for modulating the data. The modulated data is recorded on a disk record medium.

A previously-recorded secret code is reproduced from the recording medium. The secret code represents second positional information. The secret code is decoded into the second positional information. The second positional information represents at least one of a predetermined reference pit depth and a predetermined reference physical position. The first positional information and the second positional information are collated, and a check is made as to whether or not the first positional information and the second positional information are in a second given relation. When the first positional information and the second positional information are not in the second given relation, one of outputting of a reproduced signal of the recording medium, operation of a program stored in the recording medium, and decoding of the secret code is stopped.

When processing input digital data from an input terminal 11 by circuits 13 to 16, modulating the data by a modulation circuit 17 and appending synchronization signals by a synchronization appendage circuit 18, the synchronization signals are appended using a synchronization format which is different from the synchronization format conforming to the standard and which is usually not used. For example, the synchronization pattern different from the regular synchronization pattern may be used, or the synchronization signal may be inserted at a position different from the regular position. If attempts are made for direct copying of the digital bi-level signal having such synchronization format, synchronization may be disengaged, for example, thus obstructing and prohibiting duplication.

A recording and reproducing system for performing the reproduction using an optical recording medium. A physical feature of a ROM type disk is extracted and enciphered before being recorded in an optical disk. The cipher reproduced and converted into a plain text physical feature, which in turn, is compared with the physical feature information detected from the ROM disk. When both are coincident with each other, the operation of the system stops, thereby preventing the use of an illegally duplicated disk. The physical feature information, recorded on a magnetic recording layer 4 of the optical recording medium 2, is reproduced by an optical head 8 and compared with the information measured by a physical feature information detector, thereby detecting a duplicated medium.

This recording makes easy reproduction of the recorded data quite difficult. If data recorded on a bit-formed portion may be reproduced by any means, the data signal recorded on the optical disk cannot be easily reproduced.
